Terms of Service

Prices and Tax: Prices are in US dollars. A flat 10% tax is added at checkout and shown as its own line on each invoice. The tax also applies to setup fees.

All overcharges or billing disputes must be reported within 30 days of the time the dispute occurred.

Declined Payments: Credit cards that are declined for any reason are subject to a US$5.00 declination fee. Service will be interrupted on accounts that reach 3 days past due.

Renewal: Your service renews at the regular price of the plan you signed up for. One-time promo discounts, such as a first-month coupon, do not carry over to renewals. We only change the renewal price of an active service if the datacenter raises its price to us. If that happens, we will email you at least 30 days before the new price applies, and you can cancel before then. By renewing, you agree to the terms in effect at the time of renewal. Renewal invoices are created automatically.

7-Day Money-Back Guarantee: The first invoice for each new VPS or dedicated server is refundable in full if you ask within 7 days of payment. No reason is required — open a support ticket from your client area within that window. The guarantee applies to the initial order of a service only; renewal invoices and subsequent charges are not covered by it. One-time setup fees on dedicated servers are passed through from the datacenter at cost and are not refundable.

Other Refunds & Disputes: Outside the 7-day window, refunds are considered case by case for legitimate reasons. If you dispute a valid charge, you agree to pay an Administrative Fee of US$50–$150.

Failure to Pay: FormoHost will temporarily deny service or terminate this Agreement upon failure to pay charges when due. Termination will not relieve Subscriber of responsibility for accrued charges plus reasonable interest and collection fees.

PayPal Subscriptions: When you cancel our service with a PayPal subscription, you must manually cancel the automatic payment from your PayPal account. Requesting service cancellation does NOT cancel automatic payments.

Orders with fake details are strictly prohibited. We manually review orders and reserve the right to accept or decline any order.

FormoHost is bound to provide customer data if usage violates any law. Take downs are applicable for any valid DMCA/Abuse notice.

The following are strictly prohibited on our network:

Child exploitation material, email spam, hacking materials/tools, phishing sites, malware, botnets and botnet control servers, DDoS attacks, port scanning, interfering with network infrastructure, torrent/BitTorrent, cryptocurrency mining, DHCP servers, IP spoofing, and using IP or MAC addresses we did not assign to you. Violations result in immediate suspension without refund. Serious cases, such as child exploitation material or malware, are reported to the authorities.

Content: You may not host or share content that infringes copyrights, trademarks or other intellectual property. You may not sell counterfeit goods. You may not publish false statements that damage someone’s reputation. You may not share someone’s private information or private images without their consent. You may not host content that encourages self-harm or suicide, or extremist content and hate speech. Breaking these rules can lead to immediate termination without refund.

Tor and IPv6: Tor exit nodes and I2P outproxies are not allowed. Other Tor relays (entry, middle and bridge) count as relay services, so they need our approval first. Use only the IPv6 addresses we assign to you. A VPS may use at most 20 IPv6 addresses at the same time, unless we agree otherwise in writing. Proxy services that rotate or randomly create IPv6 addresses are not allowed.

VPN, Proxy & Relay Services: VPN companies are welcome on our network. Because each datacenter has its own rules, running a VPN, proxy, relay or port-forwarding service for other people needs our written approval before you start. To apply, open a ticket or email business@formohost.com with your company name and website, the service you run, the countries you need and your expected monthly traffic. We confirm each request with the datacenter in that country, so some services are not available in every location. Our approval lists the approved service, the locations and any conditions, for example whether P2P traffic is allowed. Where the approval allows something listed above, the approval applies.

For an approved service, you are responsible for all traffic through your servers, including your users’ traffic. You must act on abuse and copyright complaints we forward to you within 24 hours. Open proxies (usable without a login) and residential proxy networks are never allowed. If a service causes repeated complaints or puts our network at risk, we may limit or suspend it. Unless the harm is urgent, we will contact you first.

Game servers and IRC servers often attract DDoS attacks. They are not officially supported, and users who run them do so at their own risk.

Cancellation requests must be submitted via ticket at www.formohost.com with at least 3 days’ notice but no more than 30 days prior notice. Email is not accepted for cancellation requests.

Servers are canceled at midnight GMT 00:00. FormoHost shall not be liable for damages arising from service interruptions including hardware and network failure.

FormoHost provides technical support by ticket, limited to our area of expertise — server and virtual site physical functioning.

We do not provide support for application-specific issues (CGI, HTML programming, etc.) or support for your end customers. For assistance, email support@formohost.com.

FormoHost takes a zero-tolerance approach to sending Unsolicited Commercial Email (UCE) or SPAM. Customers may not use our network to transact in UCE or host sites advertised by UCE from other networks.

Transmitting bulk email through remote proxies making SMTP connections is prohibited and may result in suspension. We reserve the right to sample bulk email from servers to prevent blacklisting.

Even one confirmed spam complaint may lead to outgoing email (port 25) being blocked on the whole server, and the block may be permanent.

Important: Hosting websites or services that support spammers or cause our IP space to be listed in spam databases will result in immediate server removal. Second violations result in permanent removal without notice.

IP addresses assigned by FormoHost remain the property of FormoHost. Customers may use them only during the term of this Agreement. FormoHost reserves the right to change or remove IP addresses at its discretion.

Per ARIN policies, name-based hosting must be used where possible. FormoHost periodically reviews IP usage and may revoke authorization for unnecessarily assigned IPs.

Bandwidth and disk usage must not exceed the agreed allocation. FormoHost monitors usage and may assess additional charges, disconnect services, or terminate the Agreement if limits are exceeded.

Invoices are generated 14 days before the due date. Service will suspend 3 days after the due date and cancel 5 days after.

FormoHost reserves the right to suspend network access if a customer’s server violates any terms. In extreme cases, law enforcement will be contacted. Customers will not be credited for suspension time.

Violations of system or network security may result in civil or criminal liability. Prohibited activities include unauthorized access to data, probing or scanning systems, interfering with service via flooding or mailbombing, forging TCP/IP headers, and obtaining unauthorized services.

FormoHost is not obligated to monitor customer activities for violations. However, we may disclose subscriber information (IP addresses, account history, etc.) to law enforcement upon written request without further consent.

Subscribers are prohibited from engaging in illegal activities using FormoHost resources, including but not limited to: unauthorized system intrusion, creating/spreading viruses, hosting illegal publications, fraud, gambling, and trafficking of prohibited goods.

Subscribers must ensure the authenticity of provided materials and comply with all applicable laws and regulations. If violations are found, FormoHost reserves the right to terminate service immediately and report to relevant authorities.

You must provide and maintain current contact information. This Agreement may not be transferred without written consent from FormoHost. FormoHost may assign this Agreement at any time.

FormoHost is not responsible for content posted by others or linked websites. Customer agrees not to reverse engineer, decompile, or disassemble any software products.

Your use of the service is at your sole risk. FormoHost is not responsible for files or data residing on your account. You agree to maintain all appropriate backups. FormoHost does not offer backup services unless explicitly stated for a specific product.
